The magistrate Luis Henry Molina Peña, president of the Supreme Court of Justice (SCJ), appointed the node del viernes to the magistrate María Garabito Ramírez, Member of the Second Chamber of this High Court, acogiendo asi the solicitation realized by the Deputy Attorney-General of the Special Prosecution Service of the Administrative Corruption (PEPCA), Wilson Camacho, quiz hizo tal petition a las 4:33 de la tarde del mismo día.
Garabito Ramírez’s designation has the final say in resolving all issues and incidents that may derive from the PEPCA’s investigation against members of the Plenary Chamber of Deputies of the Dominican Republic (CCRD).
In respect of the provisions of Article 17 of the Ley núm. 25-91, of October 15, 1991, Organica of the Supreme Court of Justice, amended by the Ley num. 156 of 1997, it is the competence of the President of the Supreme Court of Justice to expedite the expedition following its nature and the corresponding bodies for its solution.
The PEPCA has deposited an instance with the General Secretariat of the Supreme Court of Justice, establishing that the investigators have the privilege of ampared jurisdiction under Article 154, number 1, of the Constitution of the Dominican Republic, and Articles 378 and 379 of the Code of Criminal Procedure.
The CCRD members Hugo Hugo Álvarez Pérez, Pedro Antonio Ortiz Hernández, Carlos Noés Tejada Díaz, Margarita Melenciano Corporán and Félix Álvarez Rivera, who have the privilege of jurisdiction.
