Menomonee Falls business owner says authorities raided his store to sell legal products

MENOMONEE VALLEY – The owner of a CBD store in Menomonee Falls says authorities raided his store and arrested him this week for selling products he said were legal.

The owner of Superstar Buds says that detectives from Waukesha Province told him that they had been buying shelter from him since January, and the test results found that they had an illegal amount of THC.

The sheriff of Waukesha province said in a statement on Friday that they had started investigating after becoming aware of a non-fatal overdose incident involving two young children who inadvertently ingested a CBD-related product. According to the sheriff’s office, the child’s parent is being bought from Superstar Buds.

According to the sheriff, investigators found evidence that Superstar Buds was selling products containing banned levels of delta-9-tetrahydrocannabinol (THC). The office says that these products have been labeled by the company as CBD or delta-8-THC.

“Right now it’s a disaster. We probably have more than $ 100,000 in damage between goods they destroyed and confiscated. I mean, it’s just a disaster, ”said Chris S., owner of Superstar Buds.

Chris says dozens of officers streamed into his store and seized his top-selling product, Delta 8 THC. He says his other items such as CBD and hemp flower were destroyed in the process.

“It’s soaking wet. They do not want us to sell these things, ”he says.

Chris says he and one of his employees were arrested on the day of the bust and released 24 hours later pending several drug charges.

“We move Delta 8 a lot, so I feel we are targeted because we push a lot to the market.”

Here things get confusing. Delta 8 THC is derived from hemp, while Delta 9 THC is derived from marijuana. State and federal laws both ban Delta 9 THC above the potential of 3 percent, but Delta 8 is not mentioned at all.

“Delta 8 only binds to your CB1 receptors, so it does not give you such a cloudy feeling, but it still delivers a happy, euphoric, it just makes you feel happy,” Chris said.

Chris is by no means the only Delta 8 dealer in Wisconsin. Several downtown stores in Milwaukee have been selling the product, which comes in the form of floral, vape patterns and oils, for about a year now. Hazy Dayz owner Zach Rowe also believes it is legal.

“According to the Farm Bill, 2018 hemp derivatives and isomers of the marijuana plant other than delta 9 are technically legal,” Rowe said.

Back in Menomonee Falls, the sheriff of Waukesha County says they are the main agency in the case and executed a warrant with the help of Menomonee police.

The sheriff said in his statement on Friday that during the conduct of the search, investigators seized other products of the company labeled downtown or delta-8-THC that allegedly contain banned amounts of delta-9-THC.

The office adds that three people were arrested at the business in connection with this warrant. According to the sheriff, the charge will be filed with the Waukesha County Attorneys’ Office at a future date.

Chris gave TMJ4 News a copy of the search after which he was arrested. It says law enforcement officials have the right to seize items that contain Tetrahydrocannabinol, known as THC.

The warrant says the alleged crimes include possession with the intent to supply THC, manufacture and maintain a drug trade.

“The law is crystal clear that it is currently banned in the state of Wisconsin,” said Adam Neylon of Pewaukee.

Wisconsin’s hemp pilot program for 2018 passed the legislature with almost unanimous support, including a ‘yes’ vote from Neylon. He believes the stores’ owners misunderstand the difference between federal and state law.

“I think some of the owners of these downtown stores rely on federal law to voice their case, while in the state of Wisconsin it’s very clear that none of these products, downtown or THC products that are psycho- do not contain ingredients in it, ”he said.

Neylon says he does not believe the confusion should result in arrests. He believes that an educational approach would be sufficient.

“This is a difficult situation, and I want to say it and make it clear that these are not drug dealers we are talking about,” Neylon said. ‘These are legitimate business owners and I think the issue is just a misunderstanding of the law. So, I think we need to work better to inform and enlighten them about what is legal and what is not legal. ”
