The American doctor Oms-Rivera, 67 years old, was sentenced to five years of conditional release by District Judge Francisco A. Besosa for conspiracy to commit electronic fraud, W. W. Muldrow announced, federal fiscal for the Puerto Rico District.
Oms-Rivera declares the guilty conspiracy before the electrónico committee on October 23, 2020.
As part of the tax sentence, Oms-Rivera pays $ 321,000 in restitution in favor of the Administration of Social Security (SSA, by its seal in English) and a fine of $ 7,500 to pay in 60 days. Oms-Rivera also owns a property in Harbor Lights Estate in Palmas Del Mar, Humacao; will be licensed by the DEA and will be excluded from participating in case evaluations of the SSA, Medicare, Medicaid and all of the federal medical benefit programs.
The lawsuits were filed in August 2016, when a Federal District Court in the District of Puerto Rico unveiled a formal charge of 16 charges accusing Dr. Oms-Rivera, his secretaries Mayte González Muñoz and Francisco Cabrera Alvarado, an employee of the Administration of Social Security (SSA), for fraud in the solicitation process for the benefits of security for the disability of the SSA in Puerto Rico.
González-Muñoz and Cabrera Alvarado were declared guilty in March 2017. As part of this scheme, Oms-Rivera has been able to pass on medical records to patients who are seeking security benefits due to disability. This is in order to create the appearance of a historic long medical treatment and with the proposal to engage the SSA in order to approve the benefits of disability.
The SSA proposes monetary benefits to workers with severe disabilities in the long run, who work in a staffed area by the SSA for a period of time required.
“You have been abused by the trust placed in it as a professional for personal benefit. We would like to thank our companies that have succeeded in compiling the law on their sovereign efforts and their companies have compromised in this case, ”said the Federal Tax Office Muldrow.
“This sentence reflects the work of our investigators and the United States Fiscal Office to detain this plan to defraud contributors and hold them accountable,” said Inspector General Ennis. “We will continue to defend the integrity of the SSA’s incapacity programs by aggressively searching for facilitators in the advertising process that abuses the trust deposited in them.”
The Federal Federal Fiscal Assistant Vanessa D. Bonano-Rodríguez of the Social Security Administration is responsible for the case processing.
