Sen. Josh Hawley, R-Mo., Proposed Friday that President Biden, in a tone of duality, elect the Trump-appointed district court judges for seats in appellate courts when his government begins making judicial appointments.
Hawley’s comments come during an interview with Fox News shortly after his speech at the Conservative Political Action Conference (CPAC) on Friday.
“I think it all depends on who he nominates. And if he nominates left-wing judges who will not abide by the Constitution, impose their own views, then they are definitely not going to have my support, and I would hope other Republicans would not support, ‘Hawley said.

“But you know, the Republicans need to do the right thing. That’s part of the opposition. We need to stand up and articulate why judges who do not follow the Constitution are bad for the country,” he added.
Hawley said he did not think of any specific nominees. But he said that if the president wanted to show that he was truly committed to two parties, then Biden could elevate trial judges nominated by former President Donald Trump to appellate courts.
“I would hope that if President Biden really wants to be a two-party, he should nominate a judge appointed by Trump as a judge appointed by Trump,” Hawley said. He must nominate them to the Court of Appeal. However, I do not hold my breath. ‘
With the division of the Senate this term 50-50, the committees were also divided equally. But under the Senate’s organizing resolution, nominees can move to the Senate floor without a majority vote, meaning Democrats can push nominees through without IDP assistance if they stay together. On the Senate floor, Vice President Harris could break votes.
Hawley also addressed the potential battle over a vacancy in the Supreme Court that could open under Biden.

“I think it depends on, when it happens. And I think it again depends on who gets who he nominates,” Hawley said. “My concern is what we have seen so far from President Biden is that he is completely undermining the radical left wing of his party.”

Hawley added: ‘Just look at what he is doing to cancel this energy work. You see that he rules the country according to executive order, his ridiculous COVID plan, which has very little to do with COVID … You’re already looking at the performance history, and I assume that whoever he nominates for the bank will be who wants the far-left wing. But let’s look. ‘
Biden has not yet made any appointments to federal courts, though there are dozens of vacancies he either inherited from the Trump administration or opened in the early days of his administration.
There will soon be another vacancy in the circuit court when Judge Merrick Garland of the DC Court of Appeal confirms that he is the next attorney general. The DC Circuit is considered the second highest court in the country. And there is widespread speculation that Supreme Court Justice Stephen Breyer may retire at the end of the current term, which concludes in late spring.
Hawley also told Fox News on Friday that Trump’s role in the future of the Republican Party is ‘his to define’ and panned the idea of a GOP ‘civil war’.

“I have to tell those who are really invested in this whole concept of a Republican civil war, which I think is a DC thing. I mean, you can just come here to see there is no civil war. Our voters have no interest in going back, ‘he said. “They want to go forward. And I can tell you, the same goes for home in Missouri. I mean, there’s a civil war over what? So I think it’s … a total waste of time. Is a DC Consultant Invented Thing? I just think people are not interested in it. ‘
The Biden administration did not immediately respond to Fox News’ request for comment.
