A married teacher accused of having sex with a 15-year-old student three times allegedly told a British court she was ‘too short’ on a 5-footer to make it possible make.
Mother of three Kandice Barber, 35, is accused of putting the boy in her vehicle, having sex in a field and performing a sex act on him in the woods in 2018.
But her lawyer said she was so ‘tiny’ that she only reached up to the teenager’s shoulder, making their alleged skirts physically impossible, reports The Sun.
The student initially denied the case and thought he might have fertilized her – but later conceded after the topless Snapchat photos she sent him began spreading in Princes Risborough High School in Buckinghamshire, a court heard in September .
Barber has always denied the alleged switches, claiming the intimate images were hacked from her phone.
But investigators later found a series of seemingly incriminating Google searches, including “alibi” and “lying about where you were,” The Sun reported.
On Tuesday, the jury was told that the woman had already been convicted of the message to the son of a video of her performing a sex act on her bed, according to the news office.
But her lawyer, Nadia Chbat, told Amersham Law Courts the alleged clutter never took place.
“You told the police you were behind her. You took off your clothes, ‘she told the now 18-year-old. ‘You assume she’s quite tiny, just about five feet, are she not, so you were taller than she was at that point?
‘You did not even think at the time she could reach your shoulders? ‘Let’s just understand, then you get out of the car and walk to a small wooded area – this is where she, you say, had oral sex on you,’ she said.
‘Why would you get out of the car at all? She is on top of you and you are committing a sexual act in the car. What was the need to get out of the car? Chbat continued.
‘Presumably it would have just moved a matter of her body into your pants area? “Instead, it was decided to get out of the car and walk to the wooded area,” she said.
“You both walk to this wooded area, and then you lie down in the wooded area and say that she did oral sex on you.”
The alleged victim told the court they had to get out of the vehicle because Barber was parked along a busy road near his home in Buckinghamshire, reports The Sun.
Jurors also heard that Barber allegedly threatened to bring the complainant down if he reported her.
“You can not make me blush if I learn now, poker face,” she allegedly sent an SMS to the class, according to the court.
Barber denied three charges of causing or inciting a child under the age of 16 to a sexual act, and one sexual communication with a child.
She also denied that a child caused or incited sexual activity while in a position of trust, and that he had a child’s sexual act viewed by a confidant.
