The Department of Justice’s charges against 2nd Oath Keeper seen with Roger Stone undo

Joshua James of Alabama is accused of entering the Capitol illegally on January 6th.

According to the FBI’s affidavit for James’ arrest, he was identified on photos taken in the U.S. Capitol, wearing a black hat with the words’ Oath Keepers’, as well as a distinctive badge and orange para chord.

According to court records, James was arrested Tuesday in Alabama, where prosecutors in a U.S. law firm asked that he be remanded pending further lawsuits in his case.

James is facing charges of obstruction of Congress and illegal entry. He has not listed a lawyer for him since Tuesday night.

In the FBI’s affidavit, James is described as joining other oath-takers who ‘on January 5 and 6’ served as a security feature for a speaker during the ‘Stop the Steal’ rallies and events, without identify the name of the speaker specifically.

On Monday, Robert Minuta of New York was arrested on charges of rioting in the Capitol, after the video that ABC News first discovered showed him outside a hotel in Washington on the morning of January 6, how he and others Oath Keepers flank with Stone.

Minuta, who is also facing charges of obstruction of Congress and illegal entry, has not yet pleaded guilty in his case and has been released by a New York magistrate.

In a statement to ABC News on Monday, Stone denied that he knew Minuta, saying that he was not ‘known by his name until he was identified in earlier media stories, where it is alleged that he was involved in illegal events in the Capitol’ .

“If he was indeed among those who volunteered to provide security while I was visiting Washington, I was not aware of it,” Stone said.
