Sony sued for non-compliance with warranty agreements on defective PS5 controllers

Sony is facing a class action about his post fails to comply with warranty agreements on PlayStation 5 controllers with obvious “drift” errors.

In a lawsuit filed in the Southern District of New York on February 12, the Japanese conglomerate is accused of violating the Consumer Fraud Act and violating warranty agreements regarding the PS5 DualSense wireless controllers, which according to the suit have a clear defect that causes the characters to float across the screen, even if a user does not move the joystick of the controller.

Lmarc Turner, the main applicant listed in the complaint, claims that he immediately experience a drive issue with controller after taking his PS5 home in early February. But after contacting customer service, Reportedly, Turner left some advice on troubleshooting the faulty controller and not much else.

Eventually ‘[g]because his experience with contact with Sony for the first time did not address the drive issue satisfactorily, ”Turner bought another DualSense controller for a few days later for $ 69.99, but ‘Had [he] was aware of the Drift Defect before buying his PS5, otherwise he would not have bought the PS5, or would have paid significantly less for it,“Says the complaint.

The case also alleges that Sony needed to know how widespread the drift issue was especially given “Online consumer complaints, complaints directed at it directly by consumers and through its own pre-release testing.”

“This defect significantly impedes the game and therefore impairs the core functionality of the DualSense Controller,” the complaint reads.

The DualSense controllers have been released adjacent the PS5 console in November to great fanfare after being sold out via pre-order pretty oral.

The lawsuit claims that Sony has a recall or free replacement program to replace the faulty controllers for all class members, and also ask for damages to be paid out consumers in order to compensate they for buying new controllers or any other expenses out of pocket to rectify the alleged defect.
