Passenger told police she and the driver had an argument before the accident in which two young children were killed

The passenger of the vehicle, 23-year-old Danielle Ortiz, said she and Martinez were drinking around midnight. Ortiz said she asked Martinez to take her and her children home after they quarreled, the complaint reads.

While in the passenger seat, Ortiz said police said she and Martinez had another argument. She said Martinez then started driving faster and eventually hit a barrier.

According to a criminal complaint, Ortiz’s two-month-old child, who was in a child safety seat, died in the accident. Martinez’s seven-year-old, who according to police was in the back seat, was also killed, police said.

Two other children were also in the car. Martinez’s other child suffered a defective collarbone, and Ortiz’s other child reportedly had to undergo surgery to treat internal bleeding.

Both women are charged with two counts of abandonment or abuse of a child that resulted in death, and two counts of abandonment or abuse of a child resulting in major bodily injury.
