Oneida County Appeals Judge’s Decision to Reject Nexus Center’s Rejection Motion

UTICA, NY – Oneida County has filed an appeal after a judge denied the province’s motion to dismiss a case concerning the Nexus Center project in Utica.

Heuber-Breuer Construction is suing Oneida County and the Upper Mohawk Valley Memorial Auditorium Authority for $ 10 million, after alleging that the entities violated their contract by misrepresenting the funds available to support the project.

The company claims that the province said there was a $ 49 million fund to pay for the project, which did not exist when the company signed the contract. The company is seeking $ 10 million for unpaid work completed on the project.

Two of the construction company’s initial motions were rejected in November, but an amended complaint was filed in December. On February 23, the province’s motion to dismiss the new charge was denied. They appealed the decision on 25 February

Construction on the Nexus Center was halted in May 2020.
