McConnell said in a statement that the mandate and increasing calls from liberals to expand the Supreme Court indicated “open contempt for judicial independence” and that Biden’s actions meant a “direct assault” on the judiciary.

McConnell accused Biden of violating his vow to reduce political hostility in the country, saying such a commission would be divisive.

“President Biden has campaigned for a promise to lower the temperature and unite a divided nation,” he said. “If he really meant it, he would stop giving oxygen to a dangerous, outdated idea and stand up for the party members who hawk it.”

The reprimand comes after Biden announced the formation of the bipartisan commission, chaired by former White House councilor Bob Bauer and Cristina Rodríguez, a former deputy attorney general. The group will mostly consist of law professors and former officials who have served under both parties.

The commission will consist of a total of 36 members and has 180 days from its first public meeting to complete a report on its work.
