Judge rules Claudia Tenney declared winner of NY House race

New York Republican Claudia Tenney will be crowned the winner in the race to represent the state’s 22nd Congressional District, according to the state Supreme Court ruling.

The decision by Judge Scott DelConte, state Supreme Court, to order provinces and the state Electoral Council to ratify her victory ends a three-month legal battle with another flip for Republicans, leaving the Democratic majority to 221-212 shrink it. Tenney will serve the first term, Rep. Anthony Brindisi (D), evicted.

DelConte has pledged local election councils for ‘systemic violations of state and federal election laws’, including the failure of Oneida province to process more than 2,400 voter applications. However, the judge ruled that it was not the court’s job to correct the errors.

“Every valid vote cast in New York’s 22nd Congress District has been offset and counted,” DelConte wrote.

The judge also ruled that Brindisi had failed to prove that the recognition of Tenney’s victory would cause ‘irreparable damage’, as he was further able to contest the certification in court.

Brindisi has already said he can appeal against the ruling, and he also has the option to challenge the outcome of the election directly to the House. He said a review and audit should take place after the innumerable errors and inconsistencies according to the initial score.

“I believe that a complete audit and retelling of the hand is the only way to solve this race. With the margin so thin, the ever-changing score, and the countless mistakes that have occurred, reaching today’s final number , we can not afford to wonder here, “he said. “It’s shocking at the moment, no one knows who actually won this race. My opponent and I deserve real clarity.”

Tenney currently leads with 109 votes in Brindisi and has a 0.035 percent lead. She won the seat for the first time in 2016, but lost it to Brindisi in 2018, when the Democrats had a wave cycle. Her victory would bring the number of Republican women in the House to 30, a jump of just 13 after the 2018 terms.

“It is my honor to have won this race. It was a hard campaign and I thank Anthony Brindisi for his service. Now that every legitimate vote has been counted, it is time for the results to be ratified. The voters need a vote in Congress, and I look forward to working on behalf of the 22nd Congressional District of New York, ”Tenney said in a statement.

The decisive Friday highlighted the success Republicans had at the House level in the 2020 cycle. While observers predicted that the IDP would lose as many as 15 members, the IDP eventually turned over more than a dozen seats.
