Non-US citizens or ‘foreigners’ will not receive a check

If you are considered a stranger by the IRS, you will not be included in the third stimulus test. The government defines a non-resident alien as someone who “did not pass the green card test or the substantial attendance test.” For example, if you are studying abroad in the USA.

With the first stimulus test, non-citizens had to have a Social Security number and live and work in the US to be eligible for payment. However, the second check changed the rules to allow this families with a non-civil spouse to be eligible for a second stimulus test, even if they are given a taxpayer identification number (ITIN) by the IRS and not a Social Security number. During the Senate vote Saturday, Senator Ted Cruz called for a amendment to also ban undocumented immigrants from receiving a stimulus test, which was tuned 49-50.

Are citizens who are married to a U.S. citizen eligible for their own stimulus test?

If you are considered a non-citizen, you may get a stimulus test, depending on a few factors. Under Biden’s proposal, mixed-status households with at least one family member who has a social security number eligible for the third stimulus test, assuming they meet the other requirements, including income limits.

What if you live in an American area like Puerto Rico?

With the first two stimulus checks, people living in Puerto Rico, the US Virgin Islands, American Samoa, Guam or the Commonwealth of Northern Mariana Islands were eligible to receive payments. The tax authorities in each area have in the past determined whether these groups qualified for a check. These agencies were also ordered to make the payments.
