ERIE COUNTY, NY (WKBW) – Judge Henry Nowak, High Court, on Wednesday announced restaurants in Erie County that have sued the state over restrictions in Orange Zone, which could temporarily reopen indoor dining with a permanent ruling expected next week.
The restaurants must operate under the jurisdiction of the Yellow Zone, according to the judge’s decision, which allows for indoor and outdoor meals for a maximum of four people per table.
“Let’s do it the right way, let’s be an example,” said Brandon Carr, owner of The Quarter, one of the restaurants in the pack. ‘Stay 50% capacity, make sure the tables are far removed, and that the masks are on they do not sit, and let’s do it appropriately for everyone. ”
Thirty-seven restaurants have filed a lawsuit against Governor Andrew Cuomo and other state lawmakers and health officials over the Dec. 24 halt in the Orange Zone in Erie County. The list has grown rapidly to more than 90 restaurants.
“It’s about seeing the customer, it’s about seeing how your customers treat your employees, especially the ordinary ones,” said Paul Santora, owner of Santora’s Pizza Pub and Grill Restaurants. “It’s the coolest thing. what you’ve ever seen, it’s like watching Cheers sometimes. . ”
In his ruling, Judge Nowak wrote in part: “Considering the record presented, this court cannot find evidence that the state had a rational basis to designate portions of Erie County as an Orange Zone on November 18, 2020. do not show. “
He also said the restaurants have shown that the orange zone causes residents’ hardship, unemployment and loss of income.
On January 9, the state and the restaurants presented their cases in court. Judge Nowak said he would need extra time to make a decision. Advocates for HoganWillig, representing the restaurants, have called for restaurants to reopen under the same state directives instituted in June. Lawyers for the state said they relied on CDC guidance and considered the dining room inside as a high risk.
On December 28, Judge Nowak of the New York High Court ruled that the state should compromise on COVID-19 restrictions on bars and restaurants. Neither the state nor restaurants were willing to compromise.
Lawyers at HoganWillig said the governor could not close within the constitution. Lawyers have said it infringes on owners’ rights to earn honestly.
On December 11, during his press briefing, Governor Cuomo said pubs and restaurants across the country make up only 1.43% of COVID-19 cases. Cuomo said 73.84% of COVID-19 cases come from domestic or social gatherings.
Lawyers said the government could not exclude inside the dining room because it was statistically shown that restaurants were not the cause of the COVID-19 spread.
Representatives of the state said they sympathized with the financial losses of the restaurant, but they are saving lives. The state said the distribution of COVID-19 is not allowed to be eaten indoors.

Restaurants in the orange zone not mentioned in the case will still be closed for indoor dining.
“The court’s decision only applies to our clients,” said Corey Hogan, a partner at HoganWillig. ‘to function.’
A state spokesman told 7 Eyewitness News that he was reviewing the decision.
The next step is a court hearing Tuesday before the judge decides whether the decision will be permanent.
