It calls on Pence to assume ‘the powers and duties of the office of acting president’.
The adoption of the resolution by the Democratic-led House will be a symbolic reprimand to the president, as many lawmakers are furious and wavering from the deadly attack on the Capitol by Trump supporters who want to overthrow the outcome of the 2020 election.
House Democrats plan to vote Wednesday to prosecute Trump, House Speaker Steny Hoyer said during a caucus call on Monday and cast an accusatory vote one week after rioters stormed Capitol police and some of the safest areas of the Capitol.
The House will vote Tuesday night on the resolution in which Pence insists on the 25th amendment to remove Trump, and then he plans on Wednesday at 9 a.m. ET on the indictment resolution, Hoyer said.
House Speaker Nancy Pelosi said in a statement Monday that Democrats are calling on the vice president to respond within 24 hours of the adoption of the 25th resolution.
By calling for the 25th Amendment, Pence and a majority of the Cabinet will have to vote to remove Trump from office because of his inability to ‘fulfill the powers and duties of his office’ – an unprecedented step. Pence has so far given no indication that he would take the action.
Pelosi and Senate Democratic leader Chuck Schumer called Pence a day after the Capitol attack to discuss the 25th Amendment – but Pence never accepted the call after being suspended for 25 minutes.
“At least. Of course I was – I was at home, so I ran the dishwasher and put my clothes in the laundry. We’re still waiting for him to return the call,” she told CBS on Sunday night.
In her statement Monday, Pelosi said “House Democrats” as “a next step, will continue to bring accusation legislation to the floor.”
Earlier Monday, Democrats tried to pass the 25th Amendment resolution with unanimous consent, but it was blocked by Republicans.
Pelosi accused the Republicans of the House of ‘enabling the president’s incessant, unstable and disturbed acts of sedition to continue’, adding: ‘Their complicity endangers America, destroys our democracy and it must end . ‘
