Guevara defines the method of voting applied in the TC

The President of the Constitutional Tribunal, Milton Ray Guevara, defended the voting system which he applied for in order to approve a vote, which requires the vote on the 13th minute.

This method has the motive of returning in the notice of some instances of unconstitutionality, as planted a work published this week by Listín Diario.

The President of the TC considers, however, that this voting mechanism proposes the search by consensus, the quality of the decisions and advocates legal certainty.

“The complexity and naturalness of the topics discussed, propose amplified debates that can long be able to log a consensus. In just one year, 133 sessions of the Master Plenary were held, 107 of the sessions were held during the pandemic period (Covid 19), so to speak, in a virtual way, ”he concluded.

Record that the draft Constitution provides that the decisions of the TC be adopted by a qualified majority of 9 votes or more of its juices, by which it is implied that at least one magistrate has to agree to issue a decision.

“The rules of the quorum and the majority that the constituent disposes of with absolute rigor”, shall be ensured in a discourse discourse on the new anniversary of the TC. Guevara subscribes to the approval of a referendum and calls it all institutions and officials to complete constitutional sentences and indecent evictions.
