The Chinese government has violated every article of the UN Genocide Convention in its treatment of Uighurs in Xinjiang, and is responsible for committing genocide, according to an important legal report.
The 25,000-word report, published by a non-partisan U.S. thin bank, is one of the first independent, non-governmental investigations into China’s treatment of Uighurs under the 1948 Genocide Convention.
The Chinese Communist Party (CCP), despite an increasing amount of evidence, has fundamentally denied that they committed atrocities and abuses against the Uighur Muslim minority.
Reports on the Uighur have led to increasing international outrage and diplomatic and economic isolation. The US government has already described the persecution of the Uighurs as a genocide.
Wang Yi, China’s foreign minister, told reporters in Beijing on Monday that allegations of genocide in Xinjiang “could no longer be ridiculous”. “It’s a rumor invented with ulterior motives and a total lie,” Wang said.
Under the UN Convention, signed by 152 countries, including China, genocide can be found if a party violates one of the five defined acts. A report by the Newlines Institute for Strategy and Policy, Tuesday, found that the CCP had violated everyone and accused the party of clearly having an ‘intention to destroy a national, ethnic, racial or religious group’. .
“The intention to destroy the Uighurs as a group was derived from objective evidence, consisting of comprehensive state policies and practices, that set in motion President Xi Jinping, the highest authority in China,” the report said.
The five acts are: the death of members of the group; causing serious bodily or mental harm to members of the group; deliberately apply the group conditions of life calculated to bring about their physical destruction in whole or in part institute measures to prevent births within the group; and forcibly transferring children from the group to another group.

The report cites reports of mass deaths, selective death sentences and lengthy imprisonment of elders, systemic torture and cruel treatment, including sexual abuse and torture, interrogations and indoctrination, the targeted detention of Uighur community leaders and people of childbearing age. sterilization, family separation, mass transfer schemes and the transfer of Uighur children to state-run orphanages and residences.
“The persons and entities who carry out the above acts of genocide are all state agents or bodies – acting under the effective control of the state – who intend to destroy the Uighurs as a group within the meaning of Article II of the genocide convention, ”reads the summary.
The institute said all available and verifiable evidence had been studied by dozens of experts on international law, genocide studies, Chinese ethnic policy and China. It made no recommendations.
The release of the report comes amid the CCP’s most important annual political meetings, known as the “two sessions”, when the main legislative body meets to approve new legislation, and when senior ministers advocate the press.
Chinese Premier Li Keqiang will ask questions on Thursday. However, all press conferences are well managed, with pre-determined questions.
