CARES Unemployment Extension Act (HR 133)

Monday 28 December 2020 | 10:51 am

The Tennessee Department of Labor and Labor Development (TDLWD) is currently reviewing the details of the CARES Act Unemployment Extension (HR 133) congress recently adopted and signed by President Donald Trump.

TDLWD will provide plaintiffs with additional information on the next steps they must take to receive the amended federal unemployment benefits listed in HR 133 once the program rules of the U.S. Department of Labor (USDOL) become available.

TDLWD must wait for USDOL program guidance before it can begin implementing HR 133. There is no set timeline for when states will receive this guidance from the federal government. The state cannot pay benefits until it receives rules for these customized programs. Once that happens, TDLWD will work to implement the changes as quickly as possible to provide these much-needed benefits to qualifying claimants in Tennessee.

Pandemic Unemployment Assistance (PUA)

  • It offers up to 11 weeks of extra benefits up to a maximum of 50 weeks.
  • Weekly certification is required.
  • Claims are obliged to submit from 31 January 2021 documentation that is eligible for PUA.
  • PUA is available until the week ending 13 March 2021 (no new applications after that date), with a grant for three additional benefits for those who have not reached the maximum number of weeks until the week ending 3 April 2021 .

Federal Unemployment Compensation for Pandemic (FPUC)

  • Will provide up to 11 weeks an additional benefit of $ 300 per week to qualifying claimants.
  • A claimant must be eligible to receive FPUC through a separate unemployment program.
  • Once implemented, FPUC will be available to cover unemployment weeks between 27 December 2020 and the week ending 13 March 2021.

Emergency Pandemic Unemployment Compensation (PEUC)

  • Will offer up to 11 weeks of additional benefits, up to a maximum of 24 weeks.
  • PEUC is available until the week ending 13 March 2021 (no new applications after the date), with a grant of three additional benefits for those who have not reached the maximum number of weeks until the week ending 3 April 2021 .
