Biden learns to love Brett Kavanaugh

Well well. Democrats finally appreciate Judge Brett Kavanaugh and the unit manager. We refer to Joe Biden’s day 1 dismissal of Kathy Kraninger, director of the Consumer Financial Protection Bureau (CFPB), and Peter Robb, chief board member of the National Labor Relations (NLRB).

A president earns his own people to lead administrative agencies. But the dismissal of Mr. Biden is a break with a long precedent at the NLRB and a 180 degree reversal of the democratic view on the CFPB. The good news is that this could pose a legal challenge for Supreme Court precedents.

In 2010, the Democratic Congress established the CFPB as an independent agency from which the president can only be removed by the president due to inefficiency, dereliction of duty or malpractice. While on the DC Circuit Court of Appeals, then-Judge Kavanaugh wrote both a ruling and a difference of opinion, arguing that this restriction violated the separation of powers. His logic was accepted by the Supreme Court last summer (Seila Law vs. CFPB).

For the record, Ms. Kraninger has the president’s authority to remove the blanket, though that means a future president could remove her. So it happened. Me. Kraninger received an email from the White House on Wednesday at 12:21 stating, “If you do not resign from 2 p.m. today, President Biden will remove you from office.”
