President Biden ‘ignores’ federal law with comprehensive executive orders on immigration he has signed since taking office, Texas Attorney General Ken Proxton said Sunday, creating a “major risk” to his state .

Paxton told Maria Bartiromo on Sunday Morning Futures that Biden was “out of control” and “exceeding his constitutional role” in signing the executive orders to reverse the Trump administration’s immigration policy.

“You have the Democrats’ control over both the House and the Senate so he can make those changes,” Paxton said. “He basically does not have to issue edicts from the heights, and ignores federal law.”

Biden on Tuesday signed three more executive orders proposing changes to immigration, including the creation of a task force to continue reuniting migrants separated from family members at the border, a strategy to “irregular migration” to the south border, and one that will draft a review of Trump-era legal immigration policies.

“I am not proposing new legislation, I am eliminating bad policies,” Biden said at the Oval Office at the time.

Biden had earlier signed executive orders that reversed Trump-era travel restrictions on countries that considered a security risk and sought to impose a 100-day moratorium on deportations.

Paxton was the first state attorney general to sue the Biden administration on the executive order proposing a 100-day hiatus over deportations. The state seeks a permanent order while arguing the merits of the case.

He said Biden’s executive orders effectively sent the message that the U.S. borders are open, creating a risk to his state, which shares the largest border with Mexico.

He said Texas was already struggling with human trafficking, drug smuggling and gang issues at the border, adding that Biden’s orders would only increase the cost of law enforcement, education and health services in the state.

“This is an unfunded mandate for my state and it is really difficult for us to determine what it will ultimately cost,” Paxton said.
