Apple CEO Cook, executives on the preliminary list of witnesses in the Epic Games case

(Reuters) – Apple Corps chief executive Tim Cook, software chief Craig Federighi and other executives have been named on a preliminary list of witnesses in the software giant’s case against Epic Games showed.

App Store Vice President Matt Fischer and Apple Fellow Phil Schiller were also named on the list submitted to the U.S. District Court in the Northern District of California, Oakland, of which Reuters saw a copy.

The iPhone maker is at odds with Epic Games, the maker of the popular game Fortnite, which last year tried to avoid a 30% fee charged by Apple developers in the App Store by launching its own payment system in the app . Apple banned Fortnite from its store.

In a separate court case, Epic Games listed its founder and CEO, Tim Sweeney, among his own witnesses in the case.

Apple did not immediately respond to a request for comment from Reuters, but said in a statement to Bloomberg that they were “confident that the case will prove that Epic deliberately violated its agreement to increase its revenue.”

A direct message to Epic Games on one of the official Twitter handles did not elicit an immediate response.
