What should be said about the Statute of Temporary Protection announced by President Duke

The President of Colombia, Iván Duque Márquez, informs this Monday the creation of a Temporary Protection Statute for migrants, which could be used to benefit more than thousands of Venezuelans. The announcement was made during a meeting between the Colombian mandate and the High Commission of the United Nations for Refugees, Filippo Grandi.

The new Temporary Protection Statute provides for 10 years of veterans’ leave and allows Venezuelan migrants to be able to continue their regular life in Colombia, transcurrido this time, if desed quedarse in the country, deberán apply for a resident visa.

Who can benefit from EPT?

Those Venezuelan migrants who are in Colombia on a regular basis, because they have been granted an entry and permanence permit, will carry out a permanent residence permit or a special leave permit (PEP).

Also included in this Temporary Protection Statute are the Venezuelan migrants who have applied for refuge or those who have been granted a visa before the Cancellation.

Similarly, the EPT may benefit from Venezuelan migrants under the condition of irregularities who demonstrate in Colombia before the year 31 of 2021 or those who enter regularly in the country during the first two years of the state’s vigilance.

The implementation of the EPT, which will start 90 days after the publication of the decree that the legal life, will be in charge of Colombian Migration and will be carried out in two stages: the first will be virtual, and consist of the registration of foreigners in the Register Unique of Venezuelan Migrants, a mechanism that would allow the Gobierno national to characterize and identify the Venezuelan radical population in Colombia.

The second phase, which has a present manner, will be the subject of a Personal Protection Permit, a regulation document and identification for the Venezuelan citizens who are in compliance with the statute.

Include information in the Unique Register of Venezuelan Migrants

All migrants who meet regularly in the Colombian territory must carry out the PEP transfer to the Permit for Temporary Protection, Unification and Control.

Those Venezuelan migrants who include their information in the register and, finally, do not apply for permission to be sanctioned.

Prior to the termination of the EPT vigil, the Venezuelan migrant who is staying in Colombia will have to seek and obtain a visa.

The Venezuelan migrant who, in the final stages of the EPT’s vigilance, has not regularized his migration situation, will have irregular permanence and will be deported.

What is it important for Colombia to regularize Venezuelan migrants?

The massive influx of Venezuelans in Colombia under the condition of irregularity generates a redundancy of the job offer, which implies reduction in salaries and reduction in the number of native workers.

The irregularity implies an affection of the contributions of the migrants to the economy (remittances, tributary contributions, parafiscals, etc.)

It is not known who will be stationed in the national territory representing a security and impetus risk generating public policies aimed at the integration and assimilation of migrants

Does not regulate the identification and judicial identification of migrants.

Sales for migrants

Allow to protect migrant people who are currently in irregularities.

Provides a regular migration condition and authorizes the migrant to start any activity in the legal occupation of the country, including the possibility of logging a breach or contract of employment.

The migrant must have access to the public and private institutional offer, and will have the possibility of winning as an active member of the society in terms of equality.

The ability of the migrant to generate, however, the conditions required for a wide life.

To finalize the EPT period, the migrant can apply for a visa to stay in the country.
